[ Offshore Tax ] Asset Protection Strategies in Portugal
In Portugal, the government introduced a reform to the personal income tax at the end of 2014. This reform means that income derived from foreign trust structures by Portuguese resident individuals or beneficiaries is subjected to a 28% tax. This includes income payments paid out of a trust and trusts that have been wound up with the assets distributed to the settlor. However, in this case, the 28% will only be applied to the “gain”, i.e., the difference between the value of the trust when it is wound up rather than the whole distribution.
If you have a trust while being a non-habitual resident in Portugal, it is important that you review your tax planning prior to any further distributions being made.

In 2020, a year marked by the sudden appearance of the health crisis, more than 3 million jobs were lost in the European Union (EU). Wages, on the other hand, increased in most member states. Portugal was, in fact, the 5th country in the Euro Zone where salaries rose most (2.9%). This is a higher growth rate than the EU average (0.9%) and the Eurozone average (0.6%).

[ Offshore Tax ] 4 Common Mistakes Wealthy Americans Make When Relocating to Portugal
Because of European Union (EU) laws, most notably MiFID II, many U.S. financial institutions have stopped working with EU residents. This includes U.S. expats living in Portugal. These institutions will not accept new clients living in the EU. Many firms will even proactively close your accounts when they find out you are living overseas.
MiFID II does contain a clause that allows American expats and others to buy U.S.-based investment funds. However, they must work with an experienced non-EU registered investment advisor who purchases U.S. funds on their behalf.
Portugal has unique tax regulations that require planning. These include their Non-Habitual Resident (NHR) program, their tax treatment of capital gains and Roth IRA accounts, and their gift and inheritance tax regulation.
The U.S. and Portugal are party to two separate treaties/agreements around income taxes and Social Security. These are intended to help residents avoid double taxation and other penalties. While these treaties help coordinate taxing authority between the two countries and reduce the potential for double taxation, properly interpreting these treaties and correctly applying their provisions requires training and experience. Additionally, the treaties do not eliminate all complications that can result in double taxation. Therefore, it’s in your best interests to consult with qualified advisers.

next question john is asking uh distributions from revocable trust considered pension income by the Portuguese tax authorities I'm specifically interested in investments which have not grown so this is not a cap gains question but I'm concerned that Portugal does not recognize the trust structure which it doesn't no civil law country recognizes trust there are some exceptions but generally no and could therefore consider this a distribution from pension so it's revocable and it's yeah so uh augusta correct me if I'm wrong but the tax authority will just see straight through the trust it does not exist and whatever the character of the income that you're going to receive if it is being received from a pension as you say it'll just be treated as pension income and the Portugal tax authority will be blind to the fact that it passes through a trust am i correct in seeing that modesto well to be honest
i don't know because it also depends uh of the position of the person in terms of the trust or if it it was the settler or not this is something that needs to be evaluated in detail because the rules may be different if it was the settler or not okay gotcha all right

[ Offshore Tax ] Asset Protection Strategies in Portugal
In Portugal, the government introduced a reform to the personal income tax at the end of 2014. This reform means that income derived from foreign trust structures by Portuguese resident individuals or beneficiaries is subjected to a 28% tax. This includes income payments paid out of a trust and trusts that have been wound up with the assets distributed to the settlor. However, in this case, the 28% will only be applied to the “gain”, i.e., the difference between the value of the trust when it is wound up rather than the whole distribution.
If you have a trust while being a non-habitual resident in Portugal, it is important that you review your tax planning prior to any further distributions being made.
Trusts are typically structured on common law (countries with this structure law include England, the United States, and India) and have historically fallen outside of the civil law systems across Europe. In recent years, there has been a movement for civil law countries to legislate diversity against what could be considered tax avoidance schemes. Portugal has been following suit in closing loopholes.
Now, ordinary distributions during the lifetime of the fiduciary structure (trust) to resident individuals are qualified as investment income and subject to tax at a flat rate of 28%. Even if you are a non-habitual resident, you will not be exempt from this tax law.
